1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of TRUE Driver Profit (the "Service"). The Service is operated by Thomas Staggs, trading as TRUE Driver Profit ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms.

2. Eligibility and account

You must be at least 18 years old and legally able to enter into a contract. You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

3. The Service

TRUE Driver Profit helps independent delivery drivers track earnings, expenses, and true hourly and per-mile profit across delivery platforms. Features may change as the product evolves. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular result will be achieved.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully or to help others do so
  • Engage in fraud, spam, or abusive behavior
  • Infringe anyone's intellectual property or privacy rights
  • Introduce malware, probe, scan, or otherwise interfere with the security or integrity of the Service
  • Scrape, reverse engineer, resell, or redistribute the Service without our written permission
  • Circumvent usage or feature limits

5. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Thomas Staggs and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service according to the plan you have chosen. You retain ownership of the data you enter; you grant us a limited license to host and process that data solely to provide the Service to you.

6. Payments, subscriptions, taxes, refunds, and cancellations

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, currency, invoicing, subscription renewal, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically for the same billing period unless cancelled before the renewal date. See our Refund Policy for our refund window and how to request one.

7. Suspension and termination

We may suspend or terminate your access to the Service, immediately and without notice where necessary, for: material breach of these Terms, non-payment, a security or fraud risk, repeated or serious violations of the acceptable use rules, or where required by law. You may cancel your subscription at any time through Paddle; on cancellation you retain access until the end of the current billing period.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. TRUE Driver Profit provides estimates and reports based on the information you enter and is not financial, tax, or legal advice.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us (via Paddle) in the 12 months before the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, death, or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold us harmless from any claim arising out of your violation of these Terms, your misuse of the Service, or content you submit that infringes another party's rights.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When we make material changes, we'll update the "Last updated" date and, where appropriate, notify you by email. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which Thomas Staggs resides, without regard to conflict of laws rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to any mandatory consumer protection laws that apply to you.
